Position Description:
POSITION PURPOSE
Manage compliance with federal, state and local fair employment practices statutes and requirements for all retail store and HD business entities located within one assigned Division of the Company, which includes supply chain and MET. Defend charges of discrimination filed with government regulatory agencies such as EEOC, DOL Wage & Hour and OSHA.

MAJOR TASKS, RESPONSIBILITIES, AND KEY ACCOUNTABILITIES

  • 30%  Effectively manages the investigation of charges of discrimination filed with the EEOC, Department of Labor, OSHA and other state/local fair employment practices agencies by evaluating factual and legal issues in each charge of discrimination to develop a defense strategy and ensure that all cases are thoroughly investigated and appropriate information is obtained to respond to the allegations. Conducts investigatory witness interviews and document review to include legal analysis based on facts of case to prepare Company's defense.  Evaluates issues, develops strategy, assesses company exposure to liability, performs cost/benefit analysis and recommends next steps to field leaders and business partners.
  • 40%  Prepares timely/effective responses to discrimination complaints, including evidentiary documents, data and correspondence in partnership with legal and HR leaders to limit information produced while demonstrating good faith effort to comply with agency requests.
  • 15%  Serves as company representative designated to advocate/persuade regulatory agency, including management of and attendance at mediations, hearings, fact finding conferences and on-site audits by EEOC and other state and local fair employment practices agencies, and the preparation of witnesses.
  • 5%  Performs trend analysis and reporting on high profile cases to legal, Sr. Manager and field HR leaders within assigned Division.
  • 5%  Develops training for approval by EEOC and other regulatory agencies as part of conciliation or consent decree; also may co-lead training with field HR partners.
  • 5%  Answers field inquiries, calls and questions about the I-9 and e-verify process for one designated Division of the Company.
  • Other individual projects as assigned by Sr. Manager or Sr. Director

This position reports to Sr. EEO Manager.

ENVIRONMENTAL JOB REQUIREMENTS
Environment:
Located in a comfortable indoor area. Any unpleasant conditions would be infrequent and not objectionable.
Travel:
Typically requires overnight travel 20% to 30% of the time.

ESSENTIAL SKILLS:
MINIMUM QUALIFICATIONS
Must be eighteen years of age or older.
Must be legally permitted to work in the United States.
Additional Minimum Qualifications:

Education Required:
The knowledge, skills and abilities typically acquired through the completion of a bachelor's degree program or equivalent degree in a field of study related to the job.
Years of Relevant Work Experience: 3 years
Physical Requirements:
Most of the time is spent sitting in a comfortable position and there is frequent opportunity to move about. On rare occasions there may be a need to move or lift light articles.
Additional Qualifications:
Excellent written and verbal communication skills.
Provides outstanding customer service to all internal and external customers.
Preferred Qualifications:
Advance degree in law, employee relations or human resources.
At least 3-4 years of combined experience in employment law

  • Excellent verbal and written communication skills.
