Description:

The PepsiCo Law Department is seeking a skilled and talented Patent Legal Assistant to join its Global Intellectual Property Group in Chicago, Illinois. The position will primarily support the Chicago-based IP Counsel who is responsible for Global Nutrition R&D. This role involves performing patent-related tasks, including (i) coordinating payment of annuities and maintenance fees, (ii) assisting with international patent filings and (iii) assisting with patent assertions and patent litigation. This person will collaborate with in-house patent counsel, others within the Law Department, external patent attorneys, and PepsiCo's R&D associates. The Legal Assistant will also be responsible for tracking and reporting patent activities. This person will also have individual responsibility for a significant volume of routine agreements needed by R&D associates.

Responsibilities Include:

  • Acting as primary legal representative in the submission, review, and progression of new ideas through the PepsiCo Online Patent Process tool (POPP).
  • Liaise between R&D clients and patent counsel to timely provide appropriate agreements, including negotiation of routine agreements such as non-disclosure and consulting agreements.
  • Attend and lead new invention disclosure meetings with outside counsel and inventors.
  • Coordinate PepsiCo's patent procurement and patent maintenance processes with R&D personnel and outside counsel, including communications regarding patent filing / publication / prosecution / issuance / maintenance actions.
  • Communicate with the R&D organization and outside counsel regarding timely filing of corresponding patent applications in other countries as well as prosecution / issuance / maintenance actions for such patent applications.
  • Track patent prosecution records.
  • Assist patent counsel with patent assertion and patent litigation, including document collection and interviewing R&D associates.
  • Regularly consult with and support patent counsel on outstanding patent prosecution / trade secret matters for assigned PepsiCo businesses.
  • Support in-house patent counsel on matters other than patent prosecution.



Qualifications:

  • College degree and at least 10 years paralegal training required
  • Ability to support active participation in R&D contract administration and procurement.
  • Knowledge of typical R&D related agreements and ability to negotiate routine agreements such as non-disclosure and consulting agreements.
  • Knowledge of U.S. patent prosecution procedures and familiarity with patent prosecution procedures in other countries is preferred.
  • Familiarity with patent assertion and patent litigation matters, including document collection and potential witness interviews.
  • Familiarity with patent databases and docketing systems such as CPI.
  • Excellent oral and written communication skills. Ability to clearly communicate with R&D personnel, senior R&D managers, in-house counsel, outside patent prosecution counsel, database support personnel, and other legal assistants within PepsiCo and at outside law firms.
  • Ability to grasp legal and technical concepts to the degree necessary to communicate with R&D personnel and outside counsel.
  • Superior organizational and prioritization skills to manage U.S. and ex-U.S. portfolios of R&D agreements, patents and patent applications.
  • Ability to generate memos, letters, reports etc., related to intellectual property matters. Written communications require familiarity with Word, Excel, patent database manipulation and PowerPoint presentations.
